1. General

1.1. Core Air Sports provides a service by offering a platform to sell paragliding tandem flight through the website with the domain namewww.coreairsports.com (“the Website”) owned by Core Air Sports. In the present document named Terms of Use for Purchase of Flight Tickets and Flight Rules (“Terms of Use for Flight Ticket”), the website will be jointly referred to as the “Platform”.

1.2. Please read this page when you visit Core Air Sports or when you would like to purchase a ticket. It will be deemed that you have completely understood and agreed with all the matters set forth hereinabove as a whole, with important information on visits to and/or use of the Platform starting from your first visit to Core Air Sports.

1.3. The present Terms of Use for Paragliding Tandem Flight constitute an indivisible whole with the other comments, policies and rules contained in the Platform.

2. The Parties and the Subject Matter

2.1. These Terms of Use for Paragliding Tandem Flight apply for all who visit, purchase tickets from and/or subscribe to the Platform. Under the present Terms of Use for Paragliding Tandem Flight, the term “the User” means all the people, who purchase flight tickets after becoming a member of the Platform (“the Member”) or who purchase flight tickets by simply visiting the Platform (“the Visitor”).

2.2. The owner of the Platform is the company named Core Air Sports located at “Valide-i Atik Neig. Kartalbaba St. No:13/1 Üsküdar/Istanbul”. The platform services offered through the platform are made available by Core Air Sports. Within this context, “the Service” means the User’s ticket purchase via Core Air Sports.

2.3. The carriage service pertaining to the paragliing tandem flight tickets made available for sale via the Platform is set forth clearly in the part of the Platform, where the respective ticket is bought, and Core Air Sports has no responsibility with regards to the provision of such service. Core Air Sports, acting as the intermediary for the conclusion of a distance contract with the title of an Intermediary Service Provider under the Consumer Protection Law numbered 6502 and Electronic Trade Regulation Law numbered 6563, has no responsibility with regards to the flight days, flight hours and/or similar content provided by tandem flight companies.

2.4. Core Air Sports offers an open ticket sales service without specifying the day of the flight, aiming to eliminate the restriction of users having to book a specific day for service.

2.5. These Terms of Use for Paragliding Tandem Flight qualify as a contract, and the subject matter of the contract is the sale of paragliding tandem flight tickets. The ticket price, manner of payment, flight location, expiration date of the ticket are based on information available by the time the order is concluded, and such details are also sent to the e-mail address of the Users. Within this context, relevant details are as follows:

2.6.The buyer will see the payment for their ticket in the currency they selected during the payment process, but the payment to be debited from the buyer’s card may occur in a different currency. Calculations are made based on the current exchange rate.

3. Provisions

3.1. Core Air Sports is entitled to alter the information contained or to be contained in the Platform and any forms and content therein as well as the present Terms of Use for Paragliding Tandem Flight at any time deemed desirable by Core Air Sports, without notice.

3.2. Any content and trademarks and logos created by Core Air Sports, including but not limited to the Platform design, images, and html code, are proprietary to Core Air Sports only. The users may not use, share, distribute, display, reproduce the products subject to intellectual and/or industrial rights of Core Air Sports, and may not produce works derived therefrom.

3.3. Core Air Sports may create and retain any records as set forth in the applicable legislation in relation with any transactions performed by the users in order to fulfill the liabilities imposed upon Core Air Sports under the applicable legislation, especially including the Law Numbered 5651 for Regarding Online Publications and Prevention of Offenses Perpetrated through Such Publications for the legal duration as set forth in the applicable legislation. Such transaction data may include time and duration of the visit, the pages viewed and information on the website visited before the Platform. Such data shall only be used to measure the activity on the Platform and to develop ideas to further develop the Platform. The Platform is available for access by all the Users.

3.4. The Users hereby agree and undertake that they shall not reproduce, copy, distribute, process any content contained in the Platform, including but not limited to electronic texts, visual and auditory imagery, video clips, files, databases, catalogs and lists, and shall not engage in any direct and/or indirect competition with Core Air Sports through any such actions or otherwise. Within this context, it is forbidden to copy, reproduce, transmit, and process the contents and interface without the written consent of Core Air Sports and to display the same on other websites and/or anywhere else. No content of any type accessible and/or displayed through the Platform may be used or displayed anywhere, especially including the internet, by third persons without prior written approval of Core Air Sports; any other action shall constitute unlawful use.

3.5. Access to the database, where the content accessed and/or displayed via the Platform, by third persons for the sole purpose of viewing the relevant content and/or as and within the scope authorized by Core Air Sports shall be considered lawful. Any other access shall be unlawful. Neither the database nor any information contained on the database may be copied, in part or in whole, without prior written consent of Core Air Sports, may not be transferred to other databases and may not be made accessible and available for use by third persons through such databases.

3.6. It is prohibited to retrieve information intensely from the database in order to obtain the images accessible and/or viewable through the Platform. Core Air Sports may exercise legal rights to ensure that people, who fail to observe such prohibition, are duly penalized under the applicable legislation on grounds of having “accessed the information system in an unauthorized manner”.

3.7. Core Air Sports offers no warranties as to the service provided. The platform and contents thereof are made available “as is”. Core Air Sports is in no way responsible for any losses and damages arising out of any failure, error, cancelation or delay with respect to any flight, as well as interrupted communication or a computer virus. The Users hereby agree in advance that in case of any conduct against the rules and liabilities as set forth in the present Terms of Use, Core Air Sports reserves the right to implement any sanctions, including but not limited to deny access.

3.8. Core Air Sports and Core Air Sports’s partners, employees or content providers may not be held responsible for damages that may be attributable to any errors and unintentional neglect, defects or incomplete information that may occur in the Platform as well as any interruption or delay experienced by the Users, regardless of the reason and duration for the same. All these natural or legal persons disclaim any responsibility for any claims of damages and losses by third persons as well as any relevant penalties, indemnification or consequential losses.

3.9. Core Air Sports may offer links and/or routing to other websites through the Platform. Core Air Sports may publish advertising by contracted third persons and/or application forms for various services; may lead the Users to websites of advertisers or the third parties through such forms and advertising. Existence of such links does not imply that the contents of such other websites and pages are controlled by Core Air Sports in any manner whatsoever. Core Air Sports is not responsible for confidentiality practices, contents of such other websites accessed via such link or confidentiality policies and practices of third parties. Core Air Sports has no responsibility for the content accessible via such links, and is also not responsible for any losses that may arise out of any transactions to be performed on the other websites accessed. The Users hereby agree in advance that they are solely responsible for accessing the other websites via such links.

3.10. The User in question is solely responsible for any transactions performed on the Platform by himself/herself. Subscriptions and/or purchases may be viewed by third persons using the same computer under certain circumstances, such as but not limited to those where the Users are sharing a common computer. The Users are to exercise maximum care for this purpose.

3.11. Platform membership is for personal use exclusively. The Members have the option to get more information on services and to cancel membership. The members may change or update their membership preferences or details any time as they deem desirable. The members may also close their membership accounts any time.

3.12. Terms of Use for Paragliding Tandem Flight and the other texts contained in the Platform shall automatically cease to be applicable when the Platform is shut down by Core Air Sports for any reason whatsoever. However, Core Air Sports is entitled to change its business, business partnership and domain name, and to perform the same activity under another domain name, and no such changes shall have any effect on the Terms of Use for Paragliding Tandem Flight.

4. General Rules

4.1. The User hereby agrees and undertakes to be responsible for the content and accuracy of the passenger details entered into the Platform, and that no change may be made once the information is entered into the system, and that the User is solely responsible for any damages to arise in relation therewith.

4.2. The User hereby agrees and undertakes that Core Air Sports shall not be responsible for any disputes, damages and/or demands that may arise between the tandem flight companies and the User with respect to any services offered by Core Air Sports as the intermediary, and that, in any such case, the sole contact shall be the actual provider of the service.

4.3. The User hereby agrees and undertakes in advance that Core Air Sports makes no representations to the effect that the content received from the tandem flight companies and/or intermediary institutions shall be accurate or complete; and also that Core Air Sports is not responsible for any damages arising out of an interrupted connection or communication attributable to the firms providing infrastructure for internet and telecommunications.

4.4. The User hereby agrees and undertakes in advance that Core Air Sports exercises maximum care as to accuracy of the information received from the tandem flight companies and/or intermediary firms and announced on the Platform; and that, however, Core Air Sports may not be held responsible for failure to display the specified quality and availability of any service purchased or demanded.

4.5. Core Air Sports acts as an intermediary between the user and the company providing tandem paragliding flights. The user acknowledges and agrees that Core Air Sports cannot be held responsible for any issues that may arise in the services facilitated by Core Air Sports. Additionally, Core Air Sports will not be held liable if the tandem paragliding flight cannot be conducted due to flight rules and restrictions of the company where the flight ticket is intended to be used

4.6.The User acknowledges and agrees that Core Air Sports shall not be held responsible for any issues arising from reasons beyond its control, such as any political events, strikes and public movements, operational disruptions, meteorological conditions, events affecting the activity of airspace, and technical malfunctions, which may prevent the flight from taking place. These issues may arise despite the user purchasing tickets through Core Air Sports sales channels.

4.7. The User hereby agrees and undertakes that Core Air Sports shall not be held liable for any force majeure events, exceptional circumstances, accidents, or similar incidents that may occur before, during, or after the flight for tickets purchased through Core Air Sports sales channels.

4.8. The User must enter the User’s name, TR ID No and/or passport no, e-mail address, flight location and credit or ATM card no and expiry date of the respective card correctly when making a purchase through the Platform. The User hereby agrees and undertakes that Core Air Sports shall not be responsible for any problems that may arise due to the failure to provide such information accurately and completely. In order to inform the User about the service provided, Core Air Sports shall send an electronic message using the contact details provided by the User when making the purchase.

4.9. All purchases made through Core Air Sports will be processed via Credit/Bank card or EFT/Wire Transfer. If the user chooses to pay via EFT/Wire Transfer, during the payment process, they must indicate the “name - PNR” number written on the ticket in the explanation section and deposit the amount shown at this stage into one of the specified bank accounts. Failure to deposit an amount equal to or greater than the specified amount will render the ticket invalid, and Core Air Sports shall not be held responsible for such circumstances. If the user chooses to pay with a Credit/Bank card, they accept and commit that the bank or credit card used for payment must be a member of the 3D Secure system. Since 3D Secure ensures transactions are made through its own verification system, the user acknowledges that the responsibility lies solely with them for transactions conducted through this system. Therefore, they declare that they cannot dispute payments made on the Platform. The user acknowledges that Core Air Sports is not responsible for any issues arising from 3D Secure.

4.10. When a reservation made on the Platform or a purchased service is desired to be transferred to another person, the User must contact Core Air Sports

4.11. The User hereby agrees and undertakes that, if the User is to receive a refund following purchase of a service through the Platform, the amount to be refunded shall be determined according to the terms of the airlines and/or the intermediary firm. The User also hereby agrees and undertakes that, at the end of the respective process, the amount to be refunded shall be refunded to the credit or ATM card used when purchasing the service or to the bank account specified by the User.

4.12. With regards to the flight tickets purchased from the Platform, the passengers need to have their passports and ID cards with them whenever required by the destination. Additionally, ticket sales are not provided for children under 7 years of age.

5. Rules and Terms for Tandem Flight Tickets

5.1. General Rules for Ticketing

5.1.1. It is possible to book for maximum 4 passengers at once through the Platform. On the Platform, ticket sales for children under 7 years of age are not available.

5.1.2. After completing the purchase process, the user cannot automatically change the location of their ticket through the platform. To make these changes, the user must contact via email or phone.

5.1.3. After completing the purchase process, the user must use the ticket before the expiration date specified on the ticket. If the ticket is unused and/or has expired, and the user wishes to transfer it to the next year or the current year, they are obliged to pay the price difference that may occur at the current rates.

5.1.4. If the User prefers the gender of the pilot for the tandem flight, they should specify this in the notes section.

5.1.5. No refunds are provided for lost tickets, and no travel rights are granted

5.1.6. When you confirm the ticket purchase, the ticket amount (including taxes and other fees) is charged to the credit/bank card or via wire transfer used for payment. It is not mandatory for the owner of the card used for payment to be one of the travelers.

5.2. Reservation

5.2.1. To use the ticket, contact with Core Air Sports via email or phone must be made at least 4 days before the desired date of use (reservation), and the relevant reservation process must be completed

5.2.2. Tandem Flight company and address information for passengers with reservation requests are provided at least 24 hours in advance. Core Air Sports cannot be held responsible for any disruptions, problems, etc., arising from situations where communication cannot be established due to reasons such as incorrect or incomplete information provided during the ticket purchase process

5.2.3. Passengers must be at the specified address (location of the flight, company office, or transfer point) at the specified time. Core Air Sports is not responsible for any delays or disruptions that may arise due to users’ tardiness.

5.3. Flight Rules and Terms

5.3.1. The QR code specified on the ticket or sent via email is required by the tandem flight company. The User is responsible for any inconvenience that may arise due to reasons such as the QR-coded ticket not belonging to the passenger, the passenger being under 7 years of age, or the expiration date of the ticket having passed.

5.3.2. Core Air Sports cannot be held responsible for any malfunctions, accidents, losses occurring during the flight or transfer, regardless of the source or reason, and for any damage, loss, additional expenses, or liabilities that may arise as a result.

5.3.3. Core Air Sports provides users with a photo/video service during the flight. Therefore, users do not need to pay any additional fees.

5.4. Terms for Cancelation, Refund and Change

5.4.1. Provisions of the Distance Contract Regulation and the Right of Withdrawal contained therein are not applicable for the present CONTRACT under Article 2/2-h of the Regulation.

5.4.2. The User can cancel/refund the ticket purchased through Core Air Sports within 14 days.

5.4.3. The User must contact Core Air Sports via email or phone with the ticket information for cancellation/refund or modification requests.

5.4.4. Changes, cancellations, and refunds are not permitted for promotional tickets.

5.4.5. The User can make changes to the location of tickets. However, they must pay the price difference arising from location differences.

5.4.6. If the User directly conducts cancellation/refund or change procedures with the relevant tandem paragliding flight company, they must continue all subsequent processes with the tandem paragliding flight company. In such cases, the user acknowledges that Core Air Sports is not responsible for informing the user.

5.4.7. When payments are made via credit/debit card through Core Air Sports sales channels, refunds for tickets that are eligible for refund are processed only to the card used for the ticket purchase. In cases where the expiration date of the card used for payment has passed or the card has been canceled:

- If the card holder is using another card from the same bank, then card holder’s account shall be refunded.

-If the card holder is no longer working with the bank, then the card holder is to apply to the Core Air Sports with an official letter received from the bank.

5.3.8. When payments are made via wire transfer through Core Air Sports sales channels, refunds for tickets that are eligible for refund are processed only to the account used for the ticket purchase. In cases where the bank account or account number used for payment has been canceled:

- If the account holder has another valid account number belonging to the same bank, the refund will be made to the account holder’s valid account.

- If the card holder is no longer working with the bank, then the card holder is to apply to the Core Air Sports with an official letter received from the bank.

5.4.9. A completed reservation cannot be canceled or refunded.

5.5. Charges

5.5.1. The price of each flight booked through Core Air Sports consists of the net price of the flight reservation, taxes and service fees.

6. Paragliding Tandem Company Services

6.1. Core Air Sports facilitates users to use an open ticket without being tied to a specific date by selling tandem paragliding flight tickets through the platform. Within this framework, Core Air Sports has no responsibility for flight companies failing to provide the services they commit to providing or for any issues arising from airline companies. Similarly, in accordance with the ticket sales policies and contracts of these companies, Core Air Sports is not obligated to refund the price of a ticket sold or any service fees if purchased.

7. Protection of Personal Data and Confidentiality

7.1. Core Air Sports hereby undertakes to take any measures as necessary in order to keep personal data and customer details confidential and to store the same in line with the applicable legislation. For more information on personal data, please refer to the Clarification Text Regarding Protection of Personal Data.

7.2. Core Air Sports may share data regarding visits, purchases and similar necessary details with third persons in cases, where it is necessary to do so in order to fulfill legal obligations arising out of the applicable legislation, where it is necessary to demand information in line with an ongoing investigation or interrogation conducted by the competent administrative and/or judicial authorities, and/or where it is considered necessary to provide information for the purpose of protecting the safety of the visitors.

8. General Provisions

8.1. The law of the Republic of Turkey shall govern implementation and interpretation of the present Terms of Use for Paragliding Tandem Flight Ticket as well as management of any legal relations arising hereunder. Istanbul (Merkez) Courts and Debt Enforcement Offices shall have sole jurisdiction over any disputes arising or to arise out of the present Terms of Use for Paragliding Tandem Flight Ticket.

8.2. Core Air Sports shall not be legally liable for delayed performance and/or non-performance of any liabilities arising the Terms of Use for Paragliding Tandem Flight Ticket in any case that is legally considered a force majeure case. Such and similar circumstances shall not be taken as delay, non-performance or default on the part of Core Air Sports and Core Air Sports shall not have any liability to indemnify the User for any losses and damages in any such case. The term force majeure case shall be interpreted to refer to circumstances occurring beyond the control of Core Air Sports and/or the airline firm to provide the carriage service in line with the purchased ticket, which could not be prevented despite due diligence. Within this context, cases including but not limited to natural disasters, riots, wars, strikes, epidemics, communication problems, infrastructure and internet breakdowns and/or interruptions, power outages and adverse weather conditions and/or administrative decisions shall also be considered as cases of force majeure.

8.3. The notifications to be sent to the Users when they purchase tickets shall be sent to their e-mail addresses and/or phone numbers that they enter into the respective parts of the Platform. Core Air Sports shall have no responsibility whatsoever if the Visitors and/or Members cannot be notified as they have provided inaccurate contact details.

8.4. The Users enter their preferences regarding commercial electronic messages to allow Core Air Sports contact them when becoming a member and/or purchasing a ticket. The members may always change their contact preferences via the relevant part of the Platform. The Visitors, who use the Platform without becoming a member, may also submit their communication preferences through e-mail, phone or similar methods.

8.5. The Parties hereby agree that the books and records, computer records, confirmed fax messages and e-mails of the parties shall constitute valid evidence with respect to any dispute that may arise out of the present Terms of Use for Paragliding Tandem Flight Ticket.

8.6. Core Air Sports’s failure and/or delay in exercising the rights arising out of the present Terms of Use for Paragliding Tandem Flight Ticket and/or the applicable legislation may not be interpreted as a waiver from the right in question.

9. Effect and Contact

9.1. These Terms of Use are agreed in advance by the User upon purchase of the paragliding tandem flight ticket from Core Air Sports. Under article 20 of the Distance Contracts Law that came into effect under the Consumer Protection Law numbered 6502, Core Air Sports is a company acting as the intermediary for the conclusion of a distance contract on behalf of the seller or the provider using or making available for use certain means of telecommunication via the system that it has established. Under the Distance Contracts Regulation, the sellers and the providers are directly responsible before consumers for making available the transport and accommodation services and providing the necessary information.

9.2. Within this framework, the User hereby agrees in advance that the rules and conditions as determined by the legal person providing the paragliding tandem flight service shall apply for the tickets purchased via the Platform.
